New Delhi. Delhi Development Authority has to face criticism from the court as well as from the common people regarding illegal occupation. In view of this, DDA has increased the pace of encroachment removal campaign in the last few months. Under this, DDA has freed government land from encroachment in many areas of the country’s capital. Many of these cases are also related to religious places. Now a similar case has come to light, in which Delhi High Court has rejected the petition filed by the local people, refusing to interfere in the work of DDA. This matter is related to the decades old Shiva temple built in the park. The High Court raised questions on the rights of the petitioner in this case. After the court order, the way has now been cleared for the demolition of the almost 6 decade old temple.
According to the information, petitioner Avinesh Kumar had challenged the decision of the trial court by filing a petition in the High Court. Actually, DDA had decided to demolish the Shiv temple built in Shiv Park located in Kondli vegetable market. This step of the authority was challenged in the trial court, but the lower court refused to grant relief. After this a petition was filed in Delhi High Court. Now the High Court also refused to interfere in the decision of DDA. DDA claims that Shiv temple was constructed illegally in the public park. While rejecting the petition, Delhi High Court raised questions on the rights of the petitioner. Justice Tara V. Ganju found during the hearing that the petitioner had no right on the concerned land. In such a situation, there is no point in interfering in the decision of DDA.

Delhi High Court has made harsh remarks during the hearing. The court said, ‘DDA has the rights over the land on which the Shiv temple is built. A perusal of the records shows that the petitioner and other local residents have illegally encroached upon 200 meters of land in the park and have erected a boundary wall to lay claim to that part of the park. The court made strict remarks during the hearing and said that the process of demolishing the illegal construction was obstructed for years by filing petitions on behalf of the petitioner. The court can no longer support this.

A petition was filed in the High Court claiming that the Shiva temple was constructed in the year 1969. Donations were also taken from people for this. The petition further said that he worships in the temple and the DDA’s action will take away his freedom to worship. The High Court upheld the right to worship, but also said that the petitioner was not being prevented from going to a legally built temple. The court said in clear words that the construction of the temple itself has been done illegally, in such a situation there is no question of right to worship. With this the petition was rejected.
